Article 1 - Definitions

Cooling-off period: the period within which the consumer can exercise their right of withdrawal.

Consumer: a natural person acting outside their trade, business, craft or profession.

Entrepreneur: Panter Projects, trading as WilderPaw.

Distance contract: a contract concluded between the entrepreneur and the consumer within an organised system for distance selling, using one or more means of distance communication up to and including the moment the contract is concluded.

Day: calendar day.

Article 2 - Identity of the Entrepreneur

WilderPaw is a trading name of Panter Projects, established in Amsterdam, the Netherlands.

Registered address: H. Cleyndertweg 253, 1025 DM Amsterdam, the Netherlands. This is our registered address for legal and correspondence purposes. We are an online-only store, so it is not a visiting address.

Article 3 - Applicability

These Terms apply to every offer made by WilderPaw and to every distance contract concluded between WilderPaw and the consumer.

Before the contract is concluded, the text of these Terms is made available to the consumer, in a way that allows it to be stored.

If any provision of these Terms is void, the remaining provisions stay in force and the void provision is replaced by one that reflects its original intent as closely as possible.

Nothing in these Terms limits the consumer's mandatory rights under applicable consumer law. Where a provision here conflicts with those rights, the consumer's statutory rights prevail.

Article 4 - The Offer

Offers are non-binding and may be amended by WilderPaw.

Product listings contain an accurate description, and images are intended to provide a faithful representation of the product. Obvious mistakes or errors in an offer are not binding on WilderPaw.

Prices include VAT. Any applicable customs duty for delivery within our EU shipping zone is already included in the price shown, so there is nothing extra to pay on delivery.

Article 5 - The Contract

The contract is concluded once the consumer accepts the offer and WilderPaw confirms it.

WilderPaw takes appropriate measures to secure electronic payments and data.

Every contract is subject to product availability.

Article 6 - Right of Withdrawal

The consumer may withdraw from the contract without giving a reason within 14 days of receiving the product, by informing WilderPaw with any unambiguous statement, for example by email. The consumer then has a further 14 days to return the product.

WilderPaw offers more than the law requires: a voluntary 30-day return option from the date of delivery. See our Refund Policy for exactly how this works.

Article 7 - Costs and Refunds on Withdrawal

On withdrawal from the whole order, WilderPaw refunds the price paid for the products plus the delivery charge paid at ordering.

WilderPaw refunds within 14 days of receiving the returned product, using the original payment method and at no cost to the consumer. WilderPaw may withhold the refund until it has received the goods back, or until the consumer has supplied proof of return, whichever is earlier.

The consumer may handle and inspect the product as they would in a shop. WilderPaw may reduce the refund to reflect any diminished value caused by handling beyond what is needed to establish the nature, characteristics and functioning of the product. WilderPaw will state the amount and the reason before processing such a reduction.

Article 8 - Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to products made to the consumer's specification or clearly personalised, to sealed products that are not suitable for return for health-protection or hygiene reasons once unsealed, or to services fully performed within the cooling-off period. Where an exclusion applies, WilderPaw states this clearly on the product page before the order is placed.

Article 9 - The Price

Prices include VAT and will not be increased during an offer's validity period, except where required by statutory VAT-rate changes.

Printing and typographical errors are reserved. WilderPaw is not obliged to honour a price that is clearly and recognisably incorrect.

Article 10 - Conformity and Legal Guarantee

WilderPaw guarantees that products conform to the contract, the stated specifications and applicable legal requirements.

The consumer has a legal guarantee of conformity of at least two years from delivery. If a product is not in conformity, the consumer is entitled to have it brought into conformity free of charge by repair or replacement, or to a proportionate price reduction or termination of the contract where repair or replacement is impossible, disproportionate, or not carried out within a reasonable time.

The consumer should report a defect within a reasonable period after discovering it. A report made within two months of discovery is in any case considered timely. There is no obligation to report within any shorter period.

This legal guarantee is free of charge and applies alongside our 30-day return option. It does not end when the 30 days end.

The legal guarantee does not cover damage caused by misuse, unauthorised modification, or normal wear and tear.

Article 11 - Delivery and Execution

WilderPaw takes the greatest possible care when processing and delivering orders. See our Shipping Policy for current handling and estimated delivery times.

If delivery is delayed or becomes impossible, the consumer will be notified in good time and will be entitled to cancel the order and receive a refund.

The risk of loss or damage during transit remains with WilderPaw until the order has been delivered to the consumer.

Article 12 - Payment

Payment is due at the time of ordering via the payment methods offered at checkout.

The consumer must promptly report any inaccuracies in the payment details provided.

Article 13 - Complaints

Complaints should be reported to contact@wilderpaw.com within a reasonable period after the issue is discovered.

WilderPaw will respond within 14 days, or indicate when a more detailed response can be expected.

If a complaint is justified, WilderPaw will repair or replace the product or offer an appropriate refund.

Article 14 - Liability

WilderPaw is not liable for indirect or consequential damage, such as loss of profit, unless the damage was caused by intent or gross negligence.

WilderPaw is also not liable for damage arising from force majeure, including natural disasters, pandemics, strikes or similar circumstances beyond WilderPaw's reasonable control.

These limitations never apply to: death or personal injury; damage caused by intent or gross negligence on our part; liability under mandatory product-liability law; or any other liability that cannot be excluded or limited by law. Our obligations under the legal guarantee of conformity in Article 10 are not limited by this Article.

Article 15 - Disputes

These Terms are governed by the laws of the Netherlands. This choice of law does not deprive a consumer of the protection of mandatory provisions of the law of the country where they habitually reside.

Disputes may be brought before the competent court. As a consumer, you may bring proceedings in the courts of the country where you live.
